PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING, DOWNLOADING, INSTALLING, OR USING THE VIDEO GAME ("GAME"), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS, DO NOT CONTINUE TO USE OR ACCESS THE GAME.

Acceptance of Terms

  1. 1.1. These Terms of Service ("Terms") govern your access and use of the Game developed and published by FYX Gaming, Inc. ("Company", "we", "us", or "our") and any related services (collectively, the "Services").
  2. 1.2. By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and any other applicable rules or policies that we may implement from time to time.

Eligibility

  1. 2.1. To use the Services, you must be at least 18 years old. If you are under the required age, you may only use the Services under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms.

License and Restrictions

  1. 3.1. Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Game for your personal, non-commercial use.
  2. 3.2. You agree not to:
    a. Copy, reproduce, distribute, sell, lease, or otherwise exploit the Game, except as expressly permitted by the Company.
    b. Modify, adapt, reverse engineer, or create derivative works based on the Game.
    c. Use the Game for any illegal activities or purposes.
    d. Disrupt, interfere with, or compromise the integrity or security of the Game or any of its related systems or networks.

Virtual Items and Currency

  1. 4.1. The Game may include virtual items or currency ("Virtual Goods") that can be earned, purchased, or used within the Game. Virtual Goods are non-transferable, have no real-world value, and can only be used within the Game.
  2. 4.2. You acknowledge and agree that Virtual Goods are not your property, and the Company has the absolute right to manage, regulate, control, and delete Virtual Goods at its sole discretion.

User Conduct

  1. 5.1. You are responsible for your actions and behavior while using the Services. You agree not to engage in any harassing, disruptive, or offensive conduct, including, but not limited to, hate speech, harassment, impersonation, or cheating.

Termination

  1. 6.1. The Company reserves the right to terminate your access to the Services at any time, with or without cause or notice, for any reason, including, but not limited to, violation of these Terms.

Updates and Modifications

  1. 7.1. The Company may update or modify the Game or these Terms at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

Disclaimers and Limitation of Liability

  1. 8.1. The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. The Company disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. 8.2. In no event shall the Company, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Services.

In-Game Items, Virtual Currency, and Non-Fungible Tokens (NFTs)

  1. 9.1. Description of In-Game Items, Virtual Currency, and NFTs
    a. The Game may include various types of in-game items, such as skins, weapons, or consumables, that can be acquired, used, or traded within the Game.
    b. The Game may also feature in-game keys, which can be used to unlock special content or features.
    c. Inconvertible Virtual Currency (VC) is a form of virtual currency that cannot be converted into real-world currency and can only be used within the Game to purchase in-game items, services, or other virtual goods.
    d. Non-Fungible Tokens (NFTs) are unique digital assets that represent ownership or access rights to specific in-game items or content.
  2. 9.2. Purchasing and Activating In-Game Items, Keys, and Inconvertible VC
    a. Users may purchase in-game items, keys, and inconvertible VC through the Game's virtual store, using real-world currency or other accepted payment methods.
    b. After purchasing in-game items, keys, or inconvertible VC, users can activate or use these items within the Game according to their respective functionalities.
  3. 9.3. Obtaining NFTs from In-Game Items, Keys, or Inconvertible VC
    a. Upon successful activation of certain in-game items, keys, or inconvertible VC, users may receive an associated NFT, which represents their ownership or access rights to the specific in-game asset only via the FYX Gateway at their own discretion.
    b. The process of obtaining NFTs will be subject to the specific rules, restrictions, and conditions set forth by the Company and within the Game.
    c. Users are responsible for securing and maintaining their NFTs, including any required storage or management through third-party platforms or wallets.

NFT Use, Trading, and Restrictions

  • 10.1. NFTs obtained through the FYX Gateway can be used within the Game only by destroying the NFT and creating the virtual item for use in-game. 
  • 10.2. Users may be able to trade, sell, or transfer NFTs on third-party platforms, subject to these Terms and any applicable platform rules, regulations, or policies.
  • 10.3. The Company reserves the right to impose restrictions, limitations, or conditions on the use, trade, or transfer of NFTs at its sole discretion, including, but not limited to, implementing measures to prevent fraud, abuse, or violations of these Terms.

Xsolla as Global Distributor of In-Game Items, Keys, and Inconvertible VC

  1. 11.1. Xsolla is a global distributor of in-game items, keys, and inconvertible virtual currency (VC) for the Game. Xsolla's role is limited to distributing these virtual goods and does not extend to the distribution or management of non-fungible tokens (NFTs).
  2. 11.2. By using the Services, you acknowledge and agree that your purchase and use of in-game items, keys, and inconvertible VC may be facilitated by Xsolla, subject to these Terms and any additional terms, conditions, or policies set forth by Xsolla.

Refund Policy for Activated In-Game Items, Keys, and NFTs

  1. 12.1. Users are not entitled to request a refund for any in-game items, keys, or non-fungible tokens (NFTs) that have been activated or used within the Game. By activating or using these virtual goods, users acknowledge and agree that the transaction is final and non-refundable.
  2. 12.2. If you encounter any issues or problems with your purchased in-game items, keys, or NFTs, please contact our customer support for assistance. However, the Company reserves the right to determine, in its sole discretion, whether to provide a refund, replacement, or other compensation for any such issues or problems.

(“Fyx”) collects about you when you use the website (https://cryptofights.io/) (the “Website”) and any services, content, materials, features, or functionality provided through the Website (collectively, “Services”), and how that information is used, stored, shared, and/or deleted by Fyx.Any personal information you may provide through your use and/or access of the Website is subject to the terms of this Privacy Policy, as may be updated by Fyx from time to time.   • User Provided Information
    Fyx may collect certain personally identifiable information in order for you to use the Website and/or Services, including, without limitation, (i) full name; (ii) mailing address; (iii) phone number; and/or (iv) email address. Additionally, when you send a communication via the Website, Fyx may also collect that communication, and you agree Fyx is free to use the content of any communications submitted by you for any purpose, including developing, manufacturing, and/or marketing goods or Services. We will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) you grant us permission to do so; (b) we first send notice to you that the materials or other information you submit to a particular part of a Service will be published or otherwise used with your name on it; or (c) we are required to do so by law.
  • Log File Information
    Fyx may automatically collect information about your use of the Services, including, without limitation, information about the Internet browser, IP address, operating system, mobile carrier, and/or device information automatically assigned to your computer or device used by you to access the Website and/or Services. Other information Fyx may automatically collect includes, without limitation, information about the frequency and length of (i) Website usage, (ii) Website visits (i.e. date and time), (iii) accessing your Wallet, and (iv) other actions taken through your use of the Services.  
  • Wallet Information
    We may receive information regarding use of your Wallet from our Third Party Wallet Provider. All information collected by our Third Party Wallet Provider will be done so in accordance with its Privacy Policy.
  • Transaction Information
    We may receive information regarding transactions made with out Third Party Conversion Provider. All information collected by our Third Party Conversion Provider will be done so in accordance with its Privacy Policy.
  • Cookies/other Technologies Information
    Fyx may place cookies, pixel tags, local storage, and other technologies (“Technologies”) on your device used to access the Services in order to automatically collect information through the Services. Cookies allow us to record certain pieces of information whenever you visit or interact with our Services and Websites, and to recognize you across devices.     Prevent fraudulent or other criminal activity;
    Meet legal and regulatory requirements;
    Provide access to certain functionalities and features of the Services;• Enforce the Terms of Use governing use of the Website;

To the extent permissible under applicable law, disclosure of personal identification information may also be made when necessary to establish, exercise, and defend legal claims, or protect the rights and property of Fyx, our agents, customers and others, including, without limitation, the enforcement of agreements, policies, terms and conditions of use, or the personal safety of any person.
  • 3.3 In the event that ownership of all or a part of Fyx or its business were to change via merger, acquisition, divestiture, dissolution, or sale of all or substantially all of Fyx’s assets, your information pertinent to that business' operations may be assigned or transferred to, or licensed for use by, the new owner, without any prior notice to or consent from you.
  • 3.4 If you choose to share information with social media services about your activities on the Website by, for example, connecting your social media account (i.e. Facebook account) to the Website, then we may share your personal information and information about your use of the Website with such social media websites.   1. Fyx, in its sole discretion, may include or offer third party links, products, advertisements, or services (collectively, “Third Party Websites”) via the Website. This Privacy Policy does not cover any collection or use of information that Third Party Websites may collect from you, or the practices used by third parties to collect such information, and Third Party Websites should have separate and independent privacy policies and terms of use for the purpose of collecting personal information about you. You should consult such Third Party Websites’ privacy policy, and Fyx has and assumes absolutely no responsibility or liability whatsoever for the activities of Third Party Websites. If you decide to use, click on, access, or provide any personal information to Third Party Websites, you acknowledge that you are doing so at your own risk.
6. THIRD PARTY PAYMENT PROCESSING
  1. When you pay fees through the Website, we may process your payments through a Third party Website, including, without limitation, third-party payment processers. The Third Party Website may collect certain financial information from you in order to process a payment, including your name, email address, address and other billing information. In order to delete your payment or billing information, you will need to do so with the Third Party Website, as Fyx only has minimal secure access to those records as needed to provide the Services.
7. RETAINING YOUR PERSONAL INFORMATION
  1. 7.1 Fyx will retain your personal information received as described in this Privacy Policy while you are an active user of the Website and Services, and thereafter so long as needed for purposes that are not prohibited by applicable law.   1. 15.2 Notwithstanding the foregoing arbitration provisions, in no event shall Fyx be precluded or delayed from seeking and obtaining temporary, preliminary and/or permanent injunctive relief, without the posting of any bond or proving of actual damages, against infringement or other violation of its claimed intellectual property rights, or other relief that it deems reasonably necessary to defend or enforce its rights or this Privacy Policy, in any court(s) of competent jurisdiction, and through your use of the Website, you hereby consent to, and hereby waive any objection regarding, such  jurisdiction and venue. This is without prejudice to your right to launch a claim with the data protection supervisory authority in the country in which you live or work where you think we have infringed data protection laws.
